Conditions of Use
Article 1 (Purpose) The purpose of these terms and conditions is to regulate the rights, obligations and responsibilities between the company and the customer when using the service operated by BUYDOK (global.buydok.com). Article 2 (Definition) 1. BUYDOK refers to a virtual business place set up by a company to trade goods, etc. using computers and other information and communication facilities in order to provide goods or services to customers. It is also used to mean a business operator that operates a service. 2. The type of transaction contract that occurs between BUYDOK and the customer is export agency, and the definitions of the transaction contract types are as follows. When a customer requests BUYDOK for a product sold at an Internet shopping mall in Korea, BUYDOK purchases the secured inventory or the product within Korea and then transports it to the address in the customer's local country through international transportation and export customs clearance. This means being able to receive it. Delivery is carried out via post office EMS. 3. ‘Customer’ refers to a person who accesses BUYDOK and uses the services provided by BUYDOK in accordance with these Terms and Conditions. 4. ‘Member’ refers to a person who has registered by providing personal information to BUYDOK, continuously receives information from BUYDOK, and can continuously use the services provided by BUYDOK. Article 3 (Specification, explanation and revision of terms and conditions, etc.) 1. BUYDOK contains the contents of these terms and conditions, company name, representative name, business address (including the address of the place where consumer complaints can be handled), phone number, e-mail address, business registration number, mail-order business report number, and personal information. The information management manager, etc. is posted at the bottom of the BUYDOK service screen so that users can easily identify them. However, the contents of the terms and conditions can be viewed by users through the connection screen. 2. BUYDOK provides a separate connection screen or pop-up screen to help users understand important contents such as “delivery responsibility” and “refund policy” among the contents stipulated in the terms and conditions before the user agrees to the terms and conditions. Confirmation must be sought. 3. BUYDOK is the "Act on Consumer Protection in Electronic Commerce, etc. (전자상거래등에서의소비자보호에관한법률)", "Act on Regulation of Terms and Conditions (약관의규제에관한법률)", "Basic Act on Electronic Commerce (전자거래기본법)", "Electronic Signature Act (전자서명법)", "Act on Promotion of Information and Communications Network Utilization, etc. (정보통신망이용촉진등에관한법률)", and "Act on Door-to-Door Sales, etc. (방문판매등에관한법률)" These terms and conditions may be revised to the extent that they do not violate relevant laws such as the “Consumer Protection Act (소비자보호법)”. 4. If BUYDOK revises these terms and conditions, the date of application and reason for revision will be specified and announced on the initial screen of the BUYDOK site along with the current terms and conditions from 7 days prior to the date of application until the day before the date of application. However, if changes are made to the terms and conditions that are disadvantageous to users, notice will be provided with a grace period of at least 30 days. In this case, BUYDOK clearly compares the contents before and after revision and displays them so that users can easily understand them. 5. If BUYDOK revises the terms and conditions, the revised terms and conditions will only apply to contracts concluded after the date of application, and the terms and conditions before revision will remain applicable to contracts already concluded before that date. However, if a user who has already entered into a contract wishes to be subject to the provisions of the revised Terms and Conditions by transmitting to BUYDOK within the notice period of the revised Terms and Conditions under Paragraph 3 and receiving BUYDOK's consent, the revised Terms and Conditions provisions will be applied. 6. Matters not specified in these Terms and Conditions and the interpretation of these Terms and Conditions are subject to the “Act on Consumer Protection in Electronic Commerce, etc. (전자상거래등에서의소비자보호에관한법률)”, the “Act on the Regulation of Terms and Conditions, etc. (약관의규제등에관한법률)”, and the “Consumer Protection Guidelines in Electronic Commerce, etc. (전자상거래등에서의소비자보호지침)” set by the “Fair Trade Commission. (공정거래위원회)” and in accordance with relevant laws and regulations or commercial practices. Article 4 (Provision and change of services) 1. BUYDOK performs the following tasks. 가. Provision of information on goods or services and conclusion of export contracts 나. Conclusion of a transportation contract for goods requested by the customer to be purchased or exported within Korea 다. Delivery of goods requested by customers for purchase or export 라. Other tasks determined by BUYDOK 2. If BUYDOK changes the content of the service contracted with the customer due to reasons such as out of stock of goods or changes in technical specifications, the customer will be notified of the reason immediately via chat or e-mail. Article 5 (Service interruption) 1. BUYDOK may temporarily suspend the provision of services in the event of maintenance, inspection, replacement or breakdown of information and communication equipment such as computers, or interruption of communication. 2. BUYDOK compensates for damages suffered by customers or third parties due to temporary suspension of service provision for the reasons set forth in Paragraph 1. However, this does not apply if Baidu K proves that there was no intention or negligence. 3. If the service cannot be provided due to reasons such as conversion of business type, abandonment of business, or integration between companies, BUYDOK will notify the customer in the manner prescribed in Article 8 and compensate the consumer according to the conditions originally presented by BUYDOK. However, if BUYDOK does not notify the compensation standards, etc., the customer's mileage or accumulated points will be paid to the customer in kind or in cash equivalent to the value of the currency used at BUYDOK. Article 6 (Customer Subscription) 1. Customers apply for membership by filling out customer information according to the registration form set by BUYDOK and then expressing their intention to agree to these terms and conditions. 2. BUYDOK registers customers who have applied to become customers as described in Paragraph 1 as customers unless they fall under any of the following items. 가. If the applicant has previously lost customer status pursuant to Article 7, Paragraph 3 of these Terms and Conditions, provided that 3 years have passed since the loss of customer status pursuant to Article 7, Paragraph 3, and BUYDOK's approval for membership re-registration has been obtained. Exceptions are made in this case. 나. If the registration details contain false information, missing information, or incorrect information. 다. If it is determined that registering as another customer would significantly impede BUYDOK's technology. 라. If the applicant is under 14 years of age (However, even if the applicant is over 14 years of age, use of BUYDOK service may be restricted if the applicant is a minor.) 3. The membership contract is established when BUYDOK's approval reaches the customer. 4. If there is a change in the registration information pursuant to Article 15, Paragraph 1, the customer must notify the customer of the change by modifying the member information. Article 7 (Withdrawal of membership, loss of qualification, etc.) 1. Members may request withdrawal from BUYDOK at any time, and BUYDOK will immediately process membership withdrawal. 2. If a member falls under any of the following reasons, BUYDOK may restrict or suspend membership. 가. If false information is registered when applying for membership 나. If the customer does not pay the price for goods purchased using BUYDOK or other debts borne by the customer in relation to the use of BUYDOK on the due date. 다. If you threaten the order of e-commerce, such as interfering with another person's use of BUYDOK or stealing that information. 라. If you use BUYDOK to commit an act prohibited by the law or these Terms and Conditions or contrary to public order and morals. 3. After BUYDOK restricts or suspends membership, if the same behavior is repeated more than twice or the reason is not corrected within 30 days, BUYDOK may revoke membership. 4. If BUYDOK revokes your membership, your membership registration will be cancelled. In this case, the member will be notified of this and given an opportunity to explain within a period of at least 30 days before cancellation of membership registration. Article 8 (Notification to Customers) 1. When BUYDOK provides notification to the customer, it will be sent to the e-mail address designated by the customer in advance by agreement with BUYDOK. 2. In the case of notice to an unspecified number of customers, BUYDOK may substitute individual notice by posting the notice on the BUYDOK bulletin board for more than one week. However, individual notification will be provided regarding matters that have a significant impact on the customer's transaction. Article 9 (Establishment of contract) BUYDOK concludes a contract with the customer regarding the use of the service through the procedures below. 1. The customer requests export of the product he or she wishes to purchase by paying the export costs, and BUYDOK sends a payment confirmation email to the customer or notifies the customer on the BUYDOK site, and an export contract is established between the customer and BUYDOK from the time the customer orders and pays. This is established. 2. Establishment of a customer's contract with BUYDOK means that the entire process from order payment to overseas delivery has been entrusted to BUYDOK. 3. BUYDOK may not accept your order request if the following applies: 가. If the application contains false information, missing information, or incorrect information. 나. When a customer requests export or transportation of goods prohibited by relevant laws and terms and conditions. 다. If it is determined that accepting an order would significantly impede BUYDOK technology. Article 10 (Goods subject to service) BUYDOK provides services only when the customer purchases and exports for the purpose of use. In the following cases, the product can be returned to the relevant sender after obtaining the customer's consent. If the customer's whereabouts are unclear due to reasons attributable to the customer, BUYDOK will return the item and notify the customer, and the costs may be settled by the customer or covered by processing the item at BUYDOK's discretion. 1. Animals, gold, silver bars, currency, pharmaceuticals, weapons, human body parts, precision metals, stones, refrigerated items, items requiring freezing or refrigeration, explosives, flammable dangerous goods, etc. 2. If the item is not exportable / cannot be transported by air 3. If BUYDOK determines that it is not appropriate to provide services in accordance with these Terms and Conditions due to incorrect address information, defective information, etc. 4. When targeting goods whose export or import is restricted by other relevant laws and regulations Article 11 (Payment Method) Payment for goods or services purchased from BUYDOK can be made in the following ways. 1. Paypal Payment 2. Payment by points paid by BUYDOK 3. Payment by other electronic payment methods, etc. Article 12 (Change and Cancellation of Purchase Application) 1. If the goods that have arrived and been stored at the BUYDOK Korea warehouse fall under Article 9, Paragraph 3, the delivery contract for the goods may be terminated immediately. In this case, all costs incurred for follow-up measures, such as returning the goods, will be borne by the company. This is at the customer's expense. Article 13 (Service fee payment, supply and storage of goods, etc.) 1. When requesting the export of a product from BUYDOK, the customer must pay the price of the product embodied in each product within BUYDOK in the form of each clause of Article 11. 가. After checking the goods stored at the BUYDOK address according to the export contract between BUYDOK and the customer, they are delivered to the address in the local country so that the customer can receive them. 나. BUYDOK notifies the customer of the total amount incurred for exporting the product by itemizing it before the customer makes the payment. 다. The price specified on BUYDOK is the price of purchasing the product at a wholesaler or online shopping mall in Korea, the shipping fee to the BUYDOK office in Korea, and the international shipping fee (import duties, import value-added tax, and other taxes of the local country must be handled by the customer upon receipt. ), the price includes all of BUYDOK's margins (operating profit), and if there is an additional amount to be borne by the customer, the customer will be notified in advance. 라. BUYDOK's principle is to package and deliver products requested by customers to be exported from BUYDOK based on the customer's payment unit. We do not intentionally manipulate our products to reduce taxes and other taxes. 마. In order to minimize the customer's shipping costs, BUYDOK may repackage without the customer's prior consent in order to check for overpacking and poor packaging and safely deliver the product at a lower price. If it is determined that there is a risk of damage to the product due to insufficient packaging at the product supplier, repackaging may be performed to prevent damage. In this case, the customer will be notified in advance of this fact and the customer will bear the cost of repackaging. Article 14 (Shipping and Customs Clearance) 1. Shipping 가. As a transportation contract agent, BUYDOK guarantees that its shipping partner, the Postal Service (EMS), provides and takes responsibility for air transportation from BUYDOK's Korean office to the customer's country. 나. If a defect such as damage to the product occurs due to the fault of BUYDOK or a transportation affiliate during the transportation section from the BUYDOK office to the customer-designated recipient in paragraph "가" above, compensation will be made up to the product price of KRW 500,000. However, damage compensation is not provided for items that are easily damaged or handled with care, and separate insurance must be purchased for compensation for items with a product price of 500,000 won or more. 2. Customs Clearance 가. BUYDOK performs export customs clearance procedures by treating customers as tax payers and meeting export requirements in accordance with the principles of personal export customs clearance for individual exports for use. (Customers can directly consult with the post office and customs office for import customs clearance within the local country.) 나. Items shipped via EMS are subject to post office customs clearance procedures. Article 15 (Returns, refunds, etc.) 1. If BUYDOK cannot deliver the goods for which the customer has applied for export due to reasons such as out of stock, the customer will be notified of the reason without delay, and if payment for the goods has been received in advance, within 2 business days from the date of receiving the payment, otherwise, In this case, contract termination and refund procedures will be taken within 2 business days from the date of occurrence of the cause. 2. The return and refund regulations upon customer return request are as follows. 가. Return due to simple change of mind You may return a product on the condition that you receive a refund for the amount excluding shipping costs and taxes incurred to process the return for each service performance section. In addition, costs such as international shipping charges and domestic return charges incurred during return are borne by the customer. If the credit rating of the product supplier is not certain, the purchase price paid by BUYDOK after return is refunded to the customer after the product is returned from the product supplier. Returns due to product difference, defect, breakage, damage, or contamination We will identify the liability relationship between BUYDOK or the product supplier and provide a full refund of the customer's payment amount from the person responsible. Article 16 (Settlement of Differences) 1. If there is a difference between the amount paid by the customer at the time of contract and the actual costs incurred by BUYDOK due to changes in product price, difference between estimated weight and actual transported weight, computer system and data errors, etc., BUYDOK will compensate the customer for the shortfall. It can be settled after the fact. Article 17 (Emergency measures) 1. If BUYDOK determines that the customer is using the service for illegal, illegal or unfair purposes, BUYDOK has the right to refuse receipt or delivery of the relevant goods. 2. When sanctions are imposed on goods serviced by BUYDOK by the competent government office or authority, BUYDOK, in principle, delivers the goods to the competent government office or authority. Even if the customer suffers damage as a result, BUYDOK does not bear any responsibility for such damage. 3. If the goods delivered to the BUYDOK address are deemed to have bad odors, liquid leaks, or other abnormalities, or if other urgent matters are deemed necessary and there is a justifiable reason, BUYDOK will notify the customer of the fact and move the goods to a separate location. Temporary measures, such as archiving, may be taken. Additional costs arising from this must be borne by the customer, and even if damage occurs to the customer, BUYDOK does not bear any responsibility for such damage. Article 18 (Personal Information Protection) 1. When collecting customer information, BUYDOK collects the minimum amount of information necessary to fulfill the contract. When BUYDOK collects personally identifiable information from customers, it must obtain customer consent. 3. The provided personal information cannot be used for purposes other than purposes or provided to a third party without the customer's consent, and BUYDOK assumes all responsibility for this. However, with the exception of the following cases. 가. When providing the minimum customer information (name, address, phone number) required for delivery to the delivery company for delivery purposes. 나. When it is provided in a form that does not identify specific individuals as necessary for statistical compilation, academic research, or market research 다. When necessary for settlement of payment due to transactions of goods, etc. 라. When identity verification is required to prevent theft 마. To protect personal information, BUYDOK limits the number of administrators and minimizes the number of administrators, and assumes all responsibility for customer losses resulting from loss, theft, leakage, or alteration of customer personal information. 7. BUYDOK or a third party that has received personal information from it will destroy the personal information without delay when the purpose of collection or provision of the personal information has been achieved. Article 19 (BUYDOK’s Obligations) 1. BUYDOK shall not engage in any acts prohibited by the law or these Terms and Conditions or against public order and morals, and shall do its best to continuously and stably provide goods and services in accordance with the provisions of these Terms and Conditions. 2. BUYDOK must have a security system to protect customers' personal information so that customers can use Internet services safely. 3. If BUYDOK incurs damage to a customer due to unfair labeling or advertising practices prescribed in Article 3 of the “Act on Fairness of Labeling/Advertising (표시/광고의 공정화에 관한법률)” regarding products or services, BUYDOK shall be responsible for compensating for the damage. 4. BUYDOK does not send commercial advertising e-mails that customers do not want. Article 20 (Obligations regarding customer ID and password) 1. Except in the case of Article 17, the customer is responsible for managing ID and password. 2. Customers must not allow third parties to use their ID and password. 3. If a customer becomes aware that their ID and password have been stolen or are being used by a third party, they must immediately notify BUYDOK and follow any instructions provided by BUYDOK. Article 21 (Customer Obligations) Customers must not do the following. 1. Registration of false information when applying or changing 2. Stealing someone else's information 3. Changes to information posted on BUYDOK 4. Transmitting or posting information (computer programs, etc.) other than that specified by BUYDOK 5. Infringement of intellectual property rights such as copyrights of BUYDOK and third parties 6. Actions that damage the reputation of BUYDOK and third parties or interfere with their work. 7. Disclosing or posting information that is against public order and morals, such as obscene or violent messages, videos, or voices. Article 22 (Relationship between linked site and connected site) 1. When a parent site and a child site are connected by a hyperlink, etc., the former is called the linking site and the latter is called the connected site. 2. If the linked site clearly states on the initial screen of the linked site or in a pop-up screen at the time of connection that it is not responsible for guaranteeing transactions with customers for goods, etc. independently provided by the connected site, the linked site is not responsible for guaranteeing the transaction. I won't lose. Article 23 (Attribution of copyright and restrictions on use) 1. Copyright and other intellectual property rights for works created by BUYDOK belong to BUYDOK. 2. Customers must not use, or allow third parties to use, information obtained by using BUYDOK for commercial purposes by copying, transmitting, publishing, distributing, broadcasting or other means without prior consent of BUYDOK, information for which intellectual property rights belong to BUYDOK. . 3. BUYDOK must notify the customer when using copyright belonging to the customer in accordance with the agreement. Article 24 (Dispute Resolution) 1. BUYDOK establishes and operates a damage compensation processing organization to reflect legitimate opinions or complaints raised by customers and compensate for the damage. 2. BUYDOK gives priority to complaints and opinions submitted by customers. However, if prompt processing is difficult, the customer will be notified immediately of the reason and processing schedule. 3. In the event that a customer applies for damage relief in connection with an e-commerce dispute that arises between BUYDOK and the customer, the dispute may be subject to mediation by the "Fair Trade Commission (공정거래위원회)" or a dispute resolution agency commissioned by the city/provincial governor. Article 25 (Jurisdiction and Governing Law) 1. Litigation related to e-commerce disputes that arise between BUYDOK and customers will be determined by the customer's address at the time of filing. If there is no address, the lawsuit will be under the exclusive jurisdiction of the district court with jurisdiction over the customer's place of residence. However, if the customer's address or residence at the time of filing is unclear or if the customer resides in a foreign country, the lawsuit will be filed in the competent court under the Civil Procedure Act. 2. Korean law applies to e-commerce lawsuits filed between BUYDOK and customers.
